THE PLANTATIONS LABOUR ACT, 1951

NO.LXIX OF 1951 [2nd November,1951]

  • An Act to provide for the welfare of labour, and to regulate the conditions of work, in plantations. BE it enacted by Parliament as follows:–

PRELIMINARY

  1. Short title, extent, commencement and application

INSPECTING STAFF

  1. Chief inspector and inspectors
  2. Powers and functions of inspectors

PROVISIONS AS TO HEALTH

  1. Drinking water
  2. Conservancy
  3. Medical facilities

WELFARE

  1. Canteens
  2. Creches
  3. Recreational facilities
  4. Educational facilities
  5. Housing facilities
  6. Power to make rules relating to housing
  7. Other facilities
  8. Welfare officers

HOURS AND LIMITATION OF EMPLOYMENT

  1. Weekly hours
  2. Weekly holidays
  3. Daily intervals for rest
  4. Spread-over
  5. Notice of period of work
  6. Prohibition of employment of young children
  7. Night work for women and children

Provided that nothing in this section shall be deemed to apply to midwives and nurses employed as such in any plantation.

  1. Non-adult workers to carry tokens
  2. Certificate of fitness
  3. Power to require medical examination

LEAVE WITH WAGES

  1. Application of Chapter
  2. Annual leave with wages
  3. Wages during leave period
  4. Sickness and maternity benefits

PENALTIES AND PROCEDURE

  1. Obstruction
  2. Use of false certificate of fitness
  3. Contravention of provisions regarding employment of labour
  4. Other offences
  5. Enhanced penalty after previous conviction
  6. Exemption of employer from liability in certain cases
  7. Cognizance of offences
  8. Limitation of prosecutions

MISCELLANEOUS

  1. Power to give directions
  2. Power to exempt.

Act:

Provided that no such exemption shall be granted except with the previous approval of the Central Government.
